ARIZONA DIAMONDBACKS SEASON TICKET POLICIES AND PROCEDURES
As a season ticket holder with the ARIZONA DIAMONDBACKS, you are a valued and important part of our team. To assure prompt and efficient response to your requests and needs, we request your compliance with the following policies and procedures. By sending us payment for ARIZONA DIAMONDBACKS season tickets, you indicate your willingness to comply with these procedures. Please read this information carefully. The terms "season ticket holder," "permanent rights holder" and "contact name" are collectively hereinafter referred to as "season ticket holder."
OWNERSHIP OF SEAT LOCATIONS
The ARIZONA DIAMONDBACKS own and control all rights to seat locations for ARIZONA DIAMONDBACKS home games. Purchasers of season tickets obtain a license, in the form of the ticket, to use the seat locations designated by the ticket. The ARIZONA DIAMONDBACKS in its sole and absolute discretion may revoke this license at any time upon refunding the purchase price printed on the ticket or at any time upon misconduct by the season ticket holder, without refund. This license is granted on a game-to-game basis, and is subject to all rules, regulations and policies relating to tickets as established from time to time by the ARIZONA DIAMONDBACKS, Chase Field and Major League Baseball. Legacy Club Member rights are set forth in and governed by the Standard Terms and Conditions of the Legacy Club License Agreement.
SEASON TICKET HOLDER AND ACCOUNTS
The season ticket holder is the permanent rights holder (whether person or business) on the original application for tickets, and that person or business is assigned an account. If the season ticket holder is an entity, a contact name must be provided to the ARIZONA DIAMONDBACKS. The entity may request a change in the name of the contact person for its account. A request to change the contact person of an entity must be submitted to the ARIZONA DIAMONDBACKS in writing on company or entity letterhead and signed by an authorized officer.
Season tickets should be paid for by check or credit card. If a third party payment is accepted by the ARIZONA DIAMONDBACKS, such acceptance shall not give the third party any season ticket holder or renewal privileges, or cause or require the ARIZONA DIAMONDBACKS to change the name of the season ticket holder on the account. The ARIZONA DIAMONDBACKS will treat the season ticket holder as the purchaser of season tickets in such circumstances, including purposes of season ticket renewal.
SEASON TICKET PRIVILEGES NON-TRANSFERABLE
Season ticket holders have no right to transfer the seat locations designated by their tickets to any person, whether by a request to transfer the account into another name, or by an attempt to transfer the seat locations or the renewal privilege described below by sale, gift, transfer by will or trust, property settlement, transfer to creditors, or any other means. It is important to the ARIZONA DIAMONDBACKS to protect and reward long time ARIZONA DIAMONDBACKS fans by allowing them the opportunity to relocate their seat locations rather than allowing season ticket holders to transfer accounts to friends or family members or sell them to third parties. Therefore, any attempt to sell or otherwise transfer season ticket privileges to third parties will not be recognized by the ARIZONA DIAMONDBACKS and may result in cancellation of all season ticket privileges. Any court order directing distribution of the season tickets to a person not listed as the season ticket holder, whether in bankruptcy or otherwise, will result in the ARIZONA DIAMONDBACKS exercise of its rights to immediately withdraw the license represented by the tickets, including any season ticket renewal privileges, upon refund by the ARIZONA DIAMONDBACKS of all amounts paid for games that have not yet been played.
The ARIZONA DIAMONDBACKS generally recognize three exceptions to the above policy. First, the ARIZONA DIAMONDBACKS will generally allow season tickets to be transferred to members of the season ticket holder's immediate family upon the death of the season ticket holder. A request to transfer season ticket privileges to a family member of a deceased season ticket holder must be submitted to the ARIZONA DIAMONDBACKS in writing by the deceased's personal representative or other authorized representative, and must be supported by appropriate documentation satisfactory to the ARIZONA DIAMONDBACKS. Such documentation may include but not be limited to death certificate, probate and/or trust documents, and proof of relationship.
Second, if the season ticket holder is an entity, the ARIZONA DIAMONDBACKS will generally allow season tickets to be transferred upon the sale or dissolution of an entity. A request to transfer season ticket privileges of an entity account must be submitted to the ARIZONA DIAMONDBACKS in writing, and must be supported by appropriate documentation satisfactory to the ARIZONA DIAMONDBACKS. Such documentation may include but not be limited to corporate resolution, asset or stock purchase agreement, and dissolution papers. The ARIZONA DIAMONDBACKS reserve the right to approve or reject any such requests at their sole and absolute discretion.
Third, if the season ticket holder is a Legacy Club Member, the ARIZONA DIAMONDBACKS will allow transfers of season tickets in conjunction with authorized transfers of Legacy Club Licenses pursuant to the Standard Terms and Conditions of the Legacy Club License Agreement.
SEASON TICKET RENEWAL PRIVILEGES
Subject to these policies and procedures, a full season ticket holder has an opportunity to renew the current assigned seat location for the next ARIZONA DIAMONDBACKS season. A half and partial season ticket holder has an opportunity to renew seats for the next ARIZONA DIAMONDBACKS season, but is not guaranteed the same seat location. If a half and partial season ticket holder's seat location is not available, the ARIZONA DIAMONDBACKS will make reasonable efforts to relocate the half and partial season ticket holder to seats generally in the same price range and in the same general area as the half and partial season ticket holder's former assigned seat location. The opportunity to renew is a privilege granted by the ARIZONA DIAMONDBACKS and may be revoked at the ARIZONA DIAMONDBACKS sole and absolute discretion. This renewal privilege is exercised when payment is received for the season tickets in the amount specified and by the date established by the ARIZONA DIAMONDBACKS. This renewal privilege is revocable by the ARIZONA DIAMONDBACKS at any time prior to payment or if payments are not received by the established due date.
The ARIZONA DIAMONDBACKS will exercise reasonable efforts to maintain renewal privileges however, season ticket holders are not guaranteed this opportunity. The ARIZONA DIAMONDBACKS may, in lieu of revoking the renewal privilege, allow season ticket holders to purchase a license for seats in a different location, generally but not necessarily in the same price range and in the same general area as the season ticket holder's former assigned seat locations. The ARIZONA DIAMONDBACKS will take into account, among other things, violations by season ticket holders of rules, regulations and policies of the ARIZONA DIAMONDBACKS, Chase Field and Major League Baseball in deciding whether to revoke renewal privileges. Such violations include, without limitation, any unapproved transfer or attempt to transfer rights to the seat locations represented by season tickets as discussed above, and violations of abusive spectator and ticket scalping rules discussed below.
Season ticket renewal invoices will be mailed to the season ticket holder approximately one week after the end of the regular season. The payment deadline date will be specified on the invoice. Due to the time required to process relocation requests, accounts not meeting the payment deadline are subject to cancellation. If you do not receive the appropriate mailings, please contact Season Ticket Services at (602) 514-4444. If you do not contact Season Ticket Services within a reasonable time, the ARIZONA DIAMONDBACKS may revoke your renewal privilege and your priority numbers for seat locations. All payments received for season tickets are non-refundable and non-transferable.
DISTRIBUTION OF TICKETS
Fully paid season ticket accounts will receive their tickets approximately two (2) weeks prior to the first game of the season ticket package. Season tickets will be mailed to the season ticket holder or may be picked up at the Chase Field ticket office if requested in writing by the season ticket holder at the time of payment.
SEAT LOCATION CHANGES
Requests for season ticket relocation are accepted during the renewal period. Your requests must be indicated on the season ticket relocation form (included with your invoice) along with your payment. Requests for seating changes will be considered by priority number and Legacy Club Member status. Relocation requests should indicate which areas of seating are acceptable. The request should identify the largest possible area that is acceptable for relocation and a possible increase in price. Relocations are limited by the actual cancellations that occur, Legacy Club reserved sections, half and partial ticket areas. If seats are available in the desired areas when your priority numbers are reached, your seats will be changed according to the request on the season ticket relocation form and all rights to previously assigned seats will be forfeited. Seat relocations for Legacy Club Members will be handled pursuant to the Standard Terms and Conditions of the Legacy Club License Agreement.
The ARIZONA DIAMONDBACKS reserve the right to adjust season ticket locations at any time without prior notice to or consent of the season ticket holder. Such adjustment may take place on a single game basis as needed or may be made for all or any portion of the season. In the event of any such location adjustment by the ARIZONA DIAMONDBACKS, the season ticket holder's sole remedy shall be cancellation of its account no later than thirty (30) days after the first home game of the regular season. The season ticket holder must provide the ARIZONA DIAMONDBACKS written notice of such a cancellation within sixty (60) days after notification of the adjustment. Upon receipt of such notice, the ARIZONA DIAMONDBACKS will refund to the season ticket holder any amounts paid which correspond to games not played as of the date which is five (5) business days after notice is received by the ARIZONA DIAMONDBACKS.
ADDITIONAL TICKET REQUESTS
If you wish additional seats, please notate your request on the relocation form or contact ARIZONA DIAMONDBACKS Season Ticket Services at (602) 514-4444. Your seats will be added to your account by priority number during the relocation process.
RETURNED CHECKS
If any check is returned unpaid, the merchant or its authorized agent may then debit the consumer's checking account for the amount of the check, a $25 service charge, plus any additional charges assessed by the financial institution as a result of the dishonored check, as provided for by A.R.S. 44-6852. Payment by check constitutes acceptance of these terms.
If a second check is returned, for any reason, the above paragraph will apply and an additional $25 fee will be assessed. If these efforts are unsuccessful, the returned check will be sent to the Maricopa County Attorney's Office for collection. In addition, a second new invoice including the administrative fees will be sent to the season ticket holder.
Multiple instances of returned checks may result in cancellation of a season ticket account in the ARIZONA DIAMONDBACKS sole discretion.
POSTSEASON TICKETS
Because of the ticket demand imposed by Major League Baseball during postseason events, only holders of Clubhouse Box, 1st/3rd Base Box and Diamond Level Club Seats will be guaranteed rights to purchase their seats for playoff and World Series packages. All other full and half and partial season ticket holders will be guaranteed general purchase rights for available seats for playoff and World Series packages.
It is the ARIZONA DIAMONDBACKS policy to accommodate as many season ticket holders as possible during postseason play at Chase Field. Season ticket holders will have first opportunity to purchase any available tickets after team and league requirements are met based on priority number. Season ticket holders will be notified of specific policies and procedures at the appropriate time.
LOST OR STOLEN TICKETS
Lost or stolen tickets can be replaced only under the conditions set forth by ARIZONA DIAMONDBACKS management, and only to the season ticket holder of record. DUPLICATE PASSES WILL BE ISSUED UPON PAYMENT OF THE FULL FACE VALUE OF THE LOST TICKETS. Reports of stolen tickets must be accompanied by a police report indicating the circumstances of the theft. Stolen tickets (with police report) will be replaced without additional charges. If lost tickets are later recovered, a refund of additional charges may be obtained by sending the unused lost tickets and the duplicate pass ticket stub to ARIZONA DIAMONDBACKS Season Ticket Services, within thirty (30) days after the game for which you required the pass. Please contact ARIZONA DIAMONDBACKS Season Ticket Services at (602) 514-4444 to determine eligibility for replacement tickets.
ABUSIVE SPECTATORS
If, in the opinion of game officials or ARIZONA DIAMONDBACKS personnel, a spectator verbally abuses players or coaches in a manner that interferes with a coach's or player's duty prior to, during, or after game action, or verbally, physically or otherwise abuses other spectators or any other person at the game, the spectator may, in the ARIZONA DIAMONDBACKS sole discretion, be given a warning or removed from the premises. If a warning is given and the abusive behavior continues, the spectator will be ejected by building security officers. Regardless of whether an ejected spectator was using his or her own or someone else's season ticket, the ARIZONA DIAMONDBACKS will send a written notice to the season ticket holder after the first ejection, warning the ticket holder that if the ticket holder or anyone using the ticket holder's ticket is ejected from a game for abusive behavior a second time, the ARIZONA DIAMONDBACKS may exercise their right to revoke the season tickets.
TICKET SCALPING
In general, Arizona law prohibits the sale of tickets at a premium within 200 feet of any entry to the place where the event is being held or a contiguous parking lot. The resale, or attempted resale of tickets in violation of any applicable scalping law is grounds for revocation of the tickets without refund.
CHILDREN
Lap children age two and under are admitted to all ARIZONA DIAMONDBACKS games without a ticket. Children over age two must have a ticket even when sitting on an adult's lap.
CHANGE OF ADDRESS
It is the season ticket holder's responsibility to notify ARIZONA DIAMONDBACKS Season Ticket Services, in writing, of any change of address to insure prompt delivery of tickets, notices and other dated material. The season ticket holder must sign the change of address.
NOTICES AND REQUESTS
All notices and requests relating to a season ticket account, whether or not described above, must be given in writing by the season ticket holder, and sent to the attention of ARIZONA DIAMONDBACKS Season Ticket Services. No notice or request will be effective or acted upon by the ARIZONA DIAMONDBACKS until received in writing. All correspondence concerning a season ticket account should include the account number and daytime phone number for the season ticket holder.
ADDITIONAL MATTERS
The foregoing policies and procedures attempt to cover most situations. IN THE EVENT ANY ISSUE OR MATTER RELATING TO ARIZONA DIAMONDBACKS SEASON TICKETS IS NOT COVERED, OR IF THERE IS A QUESTION OF INTERPRETATION OF THE POLICIES AND PROCEDURES OR IN THE EVENT OF ANY DISPUTE BETWEEN THE ARIZONA DIAMONDBACKS AND ANY SEASON TICKET HOLDER, OR ANY SEASON TICKET HOLDER AND A THIRD PARTY, THE ARIZONA DIAMONDBACKS RESERVE THE RIGHT TO MAKE ALL FINAL DECISIONS AND DETERMINATIONS AND TAKE ALL ACTIONS NECESSARY, IN THEIR SOLE AND ABSOLUTE DISCRETION TO RESOLVE THE ISSUE OR DISPUTE. The ARIZONA DIAMONDBACKS further reserve the right to modify any of the foregoing policies or procedures from time to time upon notice to the season ticket holder.
