Arizona Diamondbacks Scratch to the Max with your D-backs Promotion
Presented by the Arizona Lottery
OFFICIAL RULES

  1. Eligibility. The Arizona Diamondbacks Scratch to the Max with your D-backs promotion presented by the Arizona Lottery ("Promotion") is open only to "Eligible Entrants", who are persons age twenty-one (21) or older on the date of entry. Employees, partners, officers, and directors (and their immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and any person residing in their same households, whether or not related) of AZPB Limited Partnership (dba the "Arizona Diamondbacks"), Arizona Lottery, AZPB REM Limited Partnership, AZPB FM Limited Partnership, Sports & Entertainment Services, LLC, the MLB Entities (defined below), and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, sponsors of the Promotion, advertising and promotion agencies, and any and all other companies associated with the Promotion are not eligible to participate or win a prize. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, The MLB Network, LLC, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities.
  2. How to Enter. Entry into the Promotion begins on September 13, 2010 and ends on September 23, 2010 ("Entry Period"). For each $20.00 spent on Arizona Lottery scratcher tickets during an Arizona Diamondbacks remote promotional event ("Remote"), the Eligible Entrant will receive one (1) voucher valid for two (2) Infield Reserve tickets to any Arizona Diamondbacks regular season home game between September 21-26, 2010 and one (1) entry form for the Promotion. Eligible Entrants are not permitted to win more than one (1) prize package, regardless of the number of entries submitted. All entries shall become the property of the Arizona Diamondbacks and Arizona Lottery and may be used for marketing and solicitation purposes.
  3. Remotes. There will be eight (8) Remotes during the Entry Period as follows:

    *Entry at Remotes during a D-backs home game shall be through the 6th inning. Game ticket required for ballpark entry.

  4. Drawing. Upon the conclusion of each Remote, one (1) entry will be selected from the entries received at such Remote to automatically win a Finalist Prize and become a "Finalist" to win the Grand Prize. A total of eight (8) entries will be drawn. The odds of being selected depend on the number of entries received at each Remote.
  5. Notification. The Arizona Diamondbacks will make two (2) attempts to notify each Finalist by telephone. In order to qualify for the Grand Prize, each Finalist will receive an Affidavit, Prize Claim, and Release ("Release") which must be executed and returned to the Arizona Diamondbacks by mail or hand delivery no later than two (2) business days after the Release has been sent. If a Finalist: (i) cannot be contacted within twenty-four (24) hours of the final attempted notification; (ii) does not timely deliver the Release; or (iii) cannot attend the final drawing on September 26, 2010 in-person, the Finalist shall be deemed to have forfeited his/her entry and an alternate Finalist may be selected from the remaining entries. Each winner's guest (or, if such guest is a minor, his/her parent or legal guardian) must execute a Release and Waiver on or before the day of the game. The Arizona Diamondbacks may refuse entry to any guest that fails to provide an executed Release and Waiver.
  6. Final Drawing. On September 26, 2010, each Finalist will randomly receive a number during an on-field presentation. The Finalist that has the number that matches the number displayed on the ballpark's dbTV will win the Grand Prize. The odds of a Finalist being selected to win the Grand Prize are one (1) out of eight (8).
  7. Prizes. Eight (8) entries will be drawn to automatically win the following "Finalist Prize": Two (2) Baseline Box tickets to the Arizona Diamondbacks game on September 26, 2010. Estimated retail value of each Finalist Prize is $88.00. One (1) Finalist will be selected to win the following "Grand Prize": Two (2) baseline box season tickets for all Arizona Diamondbacks 2011 regular season home games; one (1) 2011 Arizona Diamondbacks regular season parking pass; the use of the RideNow Powersports Pool Suite during one (1) Arizona Diamondbacks 2011 regular season home game (date TBD); the opportunity to throw the ceremonial first pitch before one (1) Arizona Diamondbacks 2011 regular season home game (date TBD); the opportunity to view batting practice from the field before one (1) Arizona Diamondbacks 2011 regular season home game (date TBD); two (2) personalized D-backs jerseys; one (1) autographed baseball (player TBD); one (1) autographed bat (player TBD); one (1) autographed jersey (player TBD); one (1) 8"x10" family photo (eight (8) person limit) in the Arizona Diamondbacks' dugout taken by an Arizona Diamondbacks Team Photographer; and one (1) one custom Arizona Diamondbacks license plate valid for one (1) year (subject to Arizona MVD restrictions). Estimated retail value of the Grand Prize is $15,000.00. No winner may designate a transferee or assignee to receive or take delivery of any prize. The cash value of a prize will not be awarded in lieu of such prize. Prizes listed as "TBD" shall be determined by the Arizona Diamondbacks. No other substitution may be made, except by the Arizona Diamondbacks and Arizona Lottery, which reserve the right to substitute a prize in whole or in part with another prize of comparable or greater value for any reason as determined by Arizona Diamondbacks and Arizona Lottery in their sole discretion. All federal, state, and local taxes, associated with a prize are each recipient's sole responsibility. A Form 1099 shall be issued based on the value of the Grand Prize. Each winner's companions must be of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Arizona Diamondbacks, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes may govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Each winner and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the Prize. The applicable MLB Entities reserve the right to remove or to deny entry to any winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Released Parties (defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.
  8. Restrictions. The Promotion is void where prohibited by law and subject to all applicable federal, state, and local laws, rules and regulations. In the event any portion of these Official Rules is deemed invalid for any reason, such portion shall be severed from these Official Rules and the remaining portions shall remain in full force and effect. Participating in the Promotion constitutes acceptance of these Official Rules and the final decision of the Arizona Diamondbacks and Arizona Lottery as the sole judge of the Promotion. Should any prize claimant make any false statement in connection with the Promotion or is otherwise deemed ineligible, such person will be required to promptly return to the Arizona Diamondbacks his/her prize. The Arizona Diamondbacks and Arizona Lottery reserve the right to modify these Official Rules or discontinue the Promotion at any time without notice.
  9. Limitation of Liability. The Arizona Diamondbacks, Arizona Lottery, the MLB Entities and each of their respective sponsors and agencies, are not responsible for printing or typographical errors in any Promotion-related materials; or transactions that are processed late, incorrectly or are lost. The Arizona Diamondbacks reserve the right to cancel or modify the Promotion if fraud or technical difficulties compromise the integrity of the Promotion, as determined by the Arizona Diamondbacks in its sole discretion. All Eligible Entrants agree to release, discharge and hold harmless the Arizona Diamondbacks, Arizona Lottery, AZPB REM Limited Partnership, AZPB FM Limited Partnership, Sports & Entertainment Services, LLC, Maricopa County Stadium District, the MLB Entities, and each of their respective parent corporations, subsidiaries and affiliates, together with their owners, partners, employees, officers, directors and agents, including advertising and promotion agencies, from and against any and all claims, demands, injuries, losses and liabilities arising out of the Promotion or from the receipt or use of any prize or any travel or activity related to the receipt or use of any prize. Each winner, by accepting any prize, accepts all prize conditions and grants to the Arizona Diamondbacks, Arizona Lottery, MLBAM and each of their respective designees the right to publicize such winner's name, address (city and state of residence), photograph, voice and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity without additional compensation or consideration, notification, or permission, unless prohibited by law.
  10. Winners List. To receive a list of winners, send a self-addressed stamped envelope to Arizona Lottery Scratch to the Max with your D-backs Winners List, P.O. Box 2095, Phoenix, AZ 85004.
  11. Governing Law. Arizona law shall govern the Promotion and any claims arising therefrom. All participants in the Promotion agree that the venue for any claim arising from the Promotion shall be located in Phoenix, Arizona.
